Defendant was convicted by a jury of the offense of possessing an "apparatus, device or instrument for the unauthorized use of narcotic drugs," as proscribed by Γ§ 195.020, RSMo 1959, V.A.M.S. (to which revision all statutory references will refer). The Court found that defendant had previously been convicted, sentenced and imprisoned for a felony and sentenced him to imprisonment for a term of five years.
